Payless ShoeSource Inc. has agreed to pay up to $5 million to settle two class action lawsuits that claim the retailer failed to pay some of the employees for all time worked and failed to give a lawful meal and even rest breaks. If you work or have worked for Payless ShoeSource in California at any time from October 7, 2006 through November 1, 2013 as a Full-Time Sales/Store Associate, Part-Time Sales/Store Associate, Full-Time/Part-Time Greeter, and/or Temp, then the only way you can get return is by filing a claim form for Payless ShoeSource Wage and Hour Class Action Settlement at the www.PaylessWageHourClassAction.com website.
The Payless Shoesource Wage and Hour case is a consolidation of two lawsuits - the Atkins, et al. v. Payless ShoeSource, Inc. et al (case number BC447027) and the Guevara, et al. v. Payless ShoeSource, Inc., et al (case number RG11598376). Payless has denied the allegations although decided to settle the class action lawsuit to avoid the expense and ambiguity of trial. There are nearly 17,000 employees or former employees who could get benefit from this case; however you will need to pay taxes on whatever you obtain. If you submit a timely and valid claim form, you will be eligible to receive a minimum of $75. The settlement shares will be a pro-rated percentage of the number of weeks each Class Member worked in each related position in comparison to the total number of weeks worked by all Class Members in related positions.
